You are responsible for ensuring that the details you provide are accurate and complete. This includes telling us about pets, children, neighbours’ boundaries, underground services, restricted access, fragile items, irrigation systems, or other matters that may affect the work. If access is not available at the agreed time, we may treat the appointment as a cancelled or wasted visit.

4. Quotes, estimates, and changes to work

Quotes are based on the information available at the time and may be fixed or estimated depending on the nature of the work. Unless expressly stated otherwise, quotes remain valid for a limited period and may be withdrawn or revised if there is a material change in price, access, labour requirements, or scope of work.

If we discover during the job that additional work is required for safety, completion, or disposal purposes, we will try to inform you before carrying out the extra work. Where immediate action is needed to prevent damage or risk, you authorise us to take reasonable steps without delay and to charge for the additional labour, materials, or disposal costs where appropriate.

5. Payments

Payment terms will be confirmed at the time of booking or on the quotation. Unless otherwise agreed, payment is due in full on completion of the Services. For larger projects, repeat work, or special orders, we may require a deposit or part-payment in advance.

We accept payment by the methods we make available from time to time. Any agreed payment deadline must be met. If payment is not received on time, we may charge reasonable recovery costs, suspend future Services, or refuse further bookings until outstanding sums are paid. Where permitted by law, we may also charge interest on overdue amounts at the statutory rate.

6. Cancellations and rescheduling

If you need to cancel or rearrange a booking, please give us reasonable notice. Unless we agree otherwise, cancellations made at short notice may be charged in part or in full if we have already reserved time, prepared equipment, ordered materials, or incurred costs for the job.

If our team arrives at the Property and cannot carry out the work because access is unavailable, permission is not in place, weather conditions make the job unsafe, or the site is materially different from what was described, we may charge for the wasted visit and any costs reasonably incurred. We will usually try to reschedule where possible.

We may cancel or reschedule a booking if there are safety concerns, extreme weather, staff illness, equipment failure, or circumstances beyond our reasonable control. In those cases, we will make reasonable efforts to offer another appointment.

7. Customer responsibilities

You must ensure the Property is reasonably safe and accessible for us to carry out the Services. This includes removing or securing dangerous items, warning us of known hazards, and ensuring animals are kept safely away from the work area. You should also ensure we have any necessary permission to enter the Property and complete the agreed work.

You are responsible for identifying any underground cables, pipes, drains, irrigation systems, or hidden installations that could be affected by digging, cutting, or machine use. If you ask us to work in an area where the exact location of services is unknown, you accept the associated risk unless we have specifically agreed to carry out detection or investigation work.

Where a service depends on your instructions, such as the height of a hedge, the extent of pruning, or the level of clearance required, you are responsible for giving clear and timely direction. If no instructions are given, we will use our professional judgment, but we are not responsible if our interpretation differs from your personal preference.

8. Waste, green waste, and disposal regulations

Where our Services create green waste, soil, branches, turf, or other garden refuse, the handling and disposal of that waste will be agreed in advance or dealt with in line with the quotation. We may remove waste ourselves, leave it bagged on site, or arrange collection by a licensed third party, depending on the job and the arrangements made.

You must tell us if the waste includes anything that may be classed as controlled, hazardous, contaminated, or otherwise subject to special handling. This may include treated timber, chemicals, broken glass, asbestos-containing material, invasive plant matter, or items that are not garden waste. We are not obliged to remove waste that we reasonably believe cannot be disposed of lawfully or safely.

All waste handling will be carried out in accordance with applicable UK waste legislation and local rules. We may ask you to separate certain materials or confirm how waste should be treated before we proceed. If additional disposal fees arise because waste volume, type, or contamination was not disclosed accurately, those costs may be charged to you.

Where waste is left at your Property, it becomes your responsibility once the work is complete unless we have expressly agreed otherwise. You are responsible for ensuring any retained waste is managed lawfully after handover.

9. Materials, plants, and third-party products

If we supply plants, soil, compost, mulch, tools, or other materials, we will use reasonable care in selecting them and sourcing them from appropriate suppliers. However, natural products are subject to seasonal variation and may not look exactly the same as sample images or descriptions. We do not guarantee that living plants will establish successfully unless a written guarantee has been provided.

If you supply materials or plants for us to use, you are responsible for their quality and suitability unless we have agreed to inspect or specify them. We are not liable for defects caused by poor-quality supplied items, incorrect storage, or manufacturer or supplier issues beyond our control.

10. Liability and limitations

We will carry out Services with reasonable care and skill. If we fail to do so, and if the law requires a remedy, we may repeat the service, repair the issue, or provide a reasonable refund at our discretion, depending on the circumstances.

We are not responsible for damage caused by pre-existing defects, hidden conditions, structural problems, defective surfaces, unstable trees, failed drainage, unseen services, or other issues outside our reasonable control. We are also not liable for ordinary wear and tear, natural die-back, seasonal changes, weather-related effects, or the behaviour of plants after completion of the work unless we have expressly guaranteed a result in writing.

Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot legally be limited or excluded under UK law. Subject to that, our total liability for any claim arising out of a booking or service will be limited to the amount paid or payable for the specific Services giving rise to the claim.

We will not be liable for indirect or consequential losses, including loss of profit, loss of opportunity, or loss of enjoyment, except where such exclusion is not permitted by law.

11. Access, parking, and site conditions

You must provide suitable access to the Property and, where relevant, arrange any permissions required for entry, parking, loading, or waste removal. If parking charges, permits, loading restrictions, or access limitations apply, these may be added to the final price if not already included in the quotation.

If we reasonably consider that weather, unsafe ground conditions, or other site issues make the work impractical or unsafe, we may pause, adjust, or postpone the job. In such circumstances, we will act reasonably and keep disruption to a minimum.

12. Complaints

If you are unhappy with any part of our Services, please raise the issue as soon as possible so we can investigate it. We may ask for photographs, access to the site, or other information to understand the problem. We aim to resolve complaints fairly and promptly, using repeat attendance, correction work, or an appropriate refund where justified.

13. Force majeure

We will not be responsible for failure or delay caused by events outside our reasonable control. This includes severe weather, accidents, illness, supply problems, transport disruption, acts of God, fire, flooding, industrial action, utility failures, and government or legal restrictions. If such an event occurs, we may suspend the Services until it is reasonable to resume.

14. Changes to these Terms

We may update these Terms and Conditions from time to time to reflect changes in our services, business practices, or legal requirements. The version in force at the time of your booking will normally apply to that booking unless a later version is required by law or agreed between us.

15. Governing law and jurisdiction

These Terms and Conditions are governed by the laws of England and Wales. Any dispute arising from or in connection with these Terms, or with the Services we provide, will be subject to the exclusive jurisdiction of the courts of England and Wales.

16. General

If any part of these Terms is found to be unlawful or unenforceable, the remaining sections will continue in full force. No delay or failure by us to enforce any term will be treated as a waiver of that term. These Terms, together with the quotation or booking confirmation where applicable, form the agreement between us and supersede prior discussions about the same booking.
